Who we are. FUMS is a licensed mortgage broker, NMLS #2597839, licensed in Pennsylvania and Florida. Because we broker residential mortgage loans, we are a "financial institution" under the federal Gramm-Leach-Bliley Act (GLBA), 15 U.S.C. § 6801 et seq.
Scope of this policy. This Privacy Policy covers information collected through fumsolutions.com and our general business communications. If you apply for a mortgage loan with us, you will separately receive a GLBA Privacy Notice(sometimes called a "Financial Privacy Notice") describing how we collect, share, and protect your nonpublic personal financial information, together with any opt-out rights available to you. B. Information collected during a loan application
If you proceed to a mortgage application, we collect additional nonpublic personal information required to originate a loan, which may include Social Security number, date of birth, government-issued identification, bank and asset statements, tax returns, pay stubs, and information about your existing debts and properties. This information is governed primarily by the GLBA Privacy Notice referenced above.

3. Credit Reports and the Fair Credit Reporting Act
If you authorize us to do so, we may obtain a consumer report (credit report) from one or more consumer reporting agencies for the permissible purpose of evaluating your mortgage application, as permitted under the federal Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681b.
If credit is denied or the terms offered are less favorable based in whole or in part on information in a consumer report, you will receive an adverse action notice identifying the agency that supplied the report and informing you of your right to obtain a free copy of it and to dispute its accuracy.
Credit inquiries are made only with your authorization. We do not obtain consumer reports for marketing purposes.
4. SMS Text Messaging and Mobile Information
When you provide your mobile telephone number and affirmatively opt in by checking the SMS consent box on one of our forms, First USA Mortgage Solutions may send you SMS text messages relating to your inquiry, loan application status, appointment scheduling, document requests, and direct communications from your loan officer.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.Information sharing with subcontractors in support services, such as customer service providers or messaging platform providers, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
The SMS consent checkbox is separate, optional, and not pre-checked. Consent to receive SMS messages is not a condition of purchase or of receiving any service from us.

5. Telephone Calls, Do Not Call, and Recording
We maintain a written internal Do Not Call policy in accordance with federal telemarketing rules. If you ask us not to call you, we will record your request and honor it. A copy of our internal Do Not Call policy is available on request at info@fumsolutions.com.
We honor the National Do Not Call Registry and applicable state do-not-call lists, including the Florida Do Not Call list maintained by the Florida Department of Agriculture and Consumer Services.
We place calls and send text messages only during hours permitted by federal and applicable state law, based on the recipient's local time.
Some telephone calls with our team may be monitored or recorded for quality assurance and training purposes. Where recording requires notice or consent under applicable state law, notice will be given at the start of the call.
6. Sharing Your Information
We do not sell or rent your personal information.

7. Data Retention
We retain personal information for as long as necessary to provide our services and to satisfy legal, regulatory, and recordkeeping obligations applicable to mortgage brokerage.

Loan application and transaction records: retained for the periods required under federal and Pennsylvania and Florida mortgage lending regulations, generally not less than three years from the date of final action, and longer where a specific rule or investigation requires.

Inquiry, prequalification, and marketing records: retained up to three years following your last interaction with us.

Consent and opt-out records (including SMS consent and do-not-call requests): retained for at least five years, or longer where necessary to demonstrate compliance.
When information is no longer needed, we securely delete or de-identify it.
8. Data Security
We maintain administrative, technical, and physical safeguards designed to protect your information, including encryption of data in transit, access controls limiting access to personnel with a business need, secure hosting, and vendor due diligence. These measures are intended to satisfy the GLBA Safeguards Rule as applicable to our operations.
No online system is completely secure, and we cannot guarantee absolute protection. If a breach of your unencrypted personal information occurs, we will notify you and applicable regulators as required by Pennsylvania, Florida, and other applicable state breach-notification laws.

The California Consumer Privacy Act, as amended by the CPRA, provides California residents with rights to know, delete, correct, and to opt out of the sale or sharing of personal information and of certain targeted advertising. We do not sell personal information, and we do not share it for cross-context behavioral advertising as those terms are defined under the CCPA. Florida residents
We are licensed to conduct mortgage business in Florida and comply with applicable Florida consumer protection law, including the Florida Telephone Solicitation Act, Fla. Stat. § 501.059, and Florida's data breach notification law, Fla. Stat. § 501.171. The Florida Digital Bill of Rights applies only to businesses meeting statutory revenue thresholds; where it applies to us, we will honor the rights it provides.
Pennsylvania and other states
Residents of Pennsylvania and other states may have rights under state law, including breach notification rights under 73 P.S. § 2301 et seq. We honor verified requests from residents of any state to access, correct, or delete marketing information we hold, subject to our legal retention obligations.
10. Children's Privacy
Our website and services are directed to individuals 18 years of age and older. We do not knowingly collect personal information from children under 13, consistent with the Children's Online Privacy Protection Act (COPPA).
